NOTICE OF NO SIGNIFICANT IMPACT ON THE ENVIRONMENT AND
NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be
undertaken by the City of York.
REQUEST FOR RELEASE OF FUNDS
On or about February 19, 2025, the City of York will submit a request to the South Carolina
Department of Commerce, Grants Administration for the release of CDBG funds under Title I of
the Housing and Community Development Act of 1974, as amended, to undertake the following
project:
Project: City of York, Lincoln Park Improvements, CDBG Control #4- LP-24-007
Purpose: Project activities include construction as the main activity and engineering and
administration as associated activities. The primary construction activities will include a
renovated basketball court, renovated tennis court, additional and upgraded parking lot,
ADA accessibility improvements, fencing, an asphalt loop trail, sidewalks to connect
amenities in the park as well as connection to existing neighborhood sidewalks, new
playground equipment and a new playground surface, and a picnic shelter. Other
improvements will include new picnic tables, benches, trash cans, signs, and updated
lighting. Additionally, construction activities will include landscaping and stormwater
improvements in the form of stormwater improvements.
Location: The proposed project area is a 1.8-acre park located at the corner of Lincoln Road and
Walnut Street in the City of York in York County, SC.
FINDING OF NO SIGNIFICANT IMPACT
The City of York has determined that the project will have no significant impact on the human
environment. Therefore, an Environmental Impact Statement under the National Environmental
Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the
Environmental Review Record (ERR) on file at the City of York offices at the above address and
may be examined or copied weekdays between the hours of 8:30 am to 5:00 pm. The Combined
Notice can also be found during the comment period at https://yorksc.gov/.
PUBLIC COMMENTS
Any individual, group or agency may submit written comments to Community Development
Office, Catawba Regional Council of Governments, PO Box 450 / 215 Hampton Street, Rock
Hill, SC 29731. All comments received on or before February 18, 2025, will be considered by
the City prior to authorizing submission of a request for release of funds. Comments should
specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The City of York certifies to the South Carolina Department of Commerce (DOC) that Dalton
Pierce, in his capacity as City Manager, consents to accept the jurisdiction of the Federal Courts
if an action is brought to enforce responsibilities in relation to the environmental review process
and that these responsibilities have been satisfied. DOC’s approval of the certification satisfies
its responsibilities under the NEPA and related laws and authorities and allows the City of York
to use CDBG Program funds.
OBJECTIONS TO RELEASE FUNDS
DOC will accept objections to its release of funds and the City’s certification for a period of
fifteen days following the anticipated submission date or its actual receipt of the request
(whichever is later) only if they are on one of the following bases: (a) the certification was not
executed by the City’s Certifying Officer; (b) The City has omitted a step or failed to make a
decision or finding required by HUD regulations at 24 CFR Part 58; (c) The City or other
participants in the development process have committed funds, incurred costs, or undertaken
activities not authorized by 24 CFR Part 58 before approval of a release of funds by DOC; or (d)
another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that
the project is unsatisfactory from the standpoint of environmental quality. Objections must be
prepared and submitted in accordance with the required procedure (24 CFR Part 58, Sec. 58.76)
and shall be addressed to Department of Commerce, Business Incentives & Community
Development, 1201 Main Street, Suite 1600, Columbia, South Carolina 29201. Potential
objectors should contact the DOC Environmental Officer to verify the actual last day of the
objection period.
